  1. Definitions
    1. Platform Administrator - Hinter Sp. z o.o. with its registered office in Puławy, registered in the Entrepreneurs Register maintained by the District Court Lublin-Wschód in Lublin, with its registered office in Świdnik, VI Commercial Department under the KRS number 0000812678
    2. Personal Data Administrator - The Personal Data Administrator is the Platform Administrator in relation to personal data processed within the use of the Platform, as described in this Policy.
    3. Platform - an internet platform operated by the Platform Administrator, providing an electronic service, accessible at the web address transcriptmate.com
    4. Personal Data - any information about an identified or identifiable natural person, determined by one or more specific factors determining the physical, physiological, genetic, mental, economic, cultural, or social identity, including the IP address of the device, location data, internet identifier, and information collected through cookies and other similar technologies.
    5. Policy - this Privacy Policy referring to the data processed by the Platform Administrator within the use of the Platform.
    6. Terms and Conditions - terms and conditions of the transcriptmate.com/policy platform.
    7. GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
    8. User - any person who has started using the Platform;
    9. Other terms capitalized in the Policy, which are not defined in points 1.1. to 1.8. above, shall have the meaning given to them in the Terms and Conditions.

  2. Processing of Personal Data
    1. The Platform Administrator takes special care to protect the rights and freedoms of individuals whose data it processes, in particular by ensuring that the data collected by it is processed:
      1. lawfully, fairly, and in a transparent manner in relation to the data subject;
      2. for specified, explicit, and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
      3. adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed;
      4. accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;
      5. kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed;
      6. processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organizational measures.
    2. The use of the Platform requires registration based on and in accordance with the Terms and Conditions. Individuals who register within the Platform are asked to provide the necessary data for creating and servicing the registration, i.e., first and last name and email address.
    3. Providing data marked as mandatory is required to create and service an account, and failure to provide them will result in the inability to register within the Platform.
    4. Personal data is processed by the Platform Administrator in connection with enabling the use of the Platform for the purpose of providing services related to the operation and servicing of the account within the Platform (Art. 6(1)(b) GDPR), as well as for the purpose of establishing and pursuing claims or defending against claims (Art. 6(1)(f) GDPR).
    5. The use of the Platform involves the processing of Personal Data by the Personal Data Administrator on its own responsibility and to the extent necessary to provide the electronic service through the Platform;
    6. Each of the Administrators processes personal data only to the extent necessary to fulfill the purpose of the respective Administrator indicated in point 3.2 above and complies with the requirements of the GDPR.
  3. User Rights
    1. the right to access their personal data (Art. 15 GDPR), including obtaining a copy of the data (Art. 15(3) GDPR);
    2. the right to rectify (correct) or complete incomplete personal data (Art. 16 GDPR);
    3. the right to request erasure of personal data in cases provided for by law (Art. 17 GDPR);
    4. the right to request the restriction of processing of personal data (Art. 18 GDPR);
    5. the right to receive their personal data in a structured, commonly used, and machine-readable format and to transmit those data to another controller where the processing is based on consent and is carried out by automated means (Art. 20 GDPR);
    6. the right to object to the processing of personal data in cases where the processing is carried out for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller or for the purposes of the legitimate interests pursued by the controller or by a third party (Art. 21 GDPR);
    7. in cases where the processing of data is based on consent, the User has the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal;
    8. in cases where it is considered that the processing of personal data breaches the provisions of the GDPR, the User has the right to lodge a complaint with the supervisory authority, i.e., the President of the Office for Personal Data Protection with its registered office in Warsaw.
  4. Personal Data Processing Period
    1. The processing period of data by the Administrator depends on the type of service provided and the purpose of the processing. As a rule, the data is processed for the duration of the service, until the withdrawal of the given consent or the submission of an effective objection to the processing of data in cases where the legal basis for data processing is the legitimate interest of the Administrator.
    2. The data processing period may be extended if the processing is necessary to establish and pursue possible claims or to defend against them, and after this time only to the extent and for the time required by the law. After the expiration of the processing period, the data is irreversibly erased or anonymized.
  5. Data Recipients
    1. The Platform Administrator reserves the right to disclose selected information about the User to the competent authorities or third parties requesting such information, based on the appropriate legal basis and in accordance with the provisions of the applicable law.
    2. The Administrator does not transfer personal data outside the European Economic Area (EEA). The Administrator may transfer personal data outside the EEA only if necessary and with the guarantee of an adequate level of protection, in particular by:
      1. cooperating with entities processing personal data in countries for which an appropriate decision of the European Commission has been issued;
      2. using standard contractual clauses issued by the European Commission;
      3. using binding corporate rules approved by the competent supervisory authority;
    3. The Administrator always informs about the intention to transfer personal data outside the EEA at the stage of their collection.
  6. Cookies and Similar Technologies
    1. Cookies are small text files installed on the User's device when using the Platform. Cookies collect information that facilitates the use of the Platform - e.g., by remembering the User's visits to the Platform and their actions.
    2. The Administrator uses cookies primarily to provide the User with electronically provided services (necessary cookies), to improve the quality of these services (functional cookies), and to analyze the activity of Users within the Platform (analytical cookies). Therefore, the Administrator uses cookies by storing information or accessing information already stored on the User's telecommunications device (computer, phone, tablet, etc.). The cookies used for this purpose include:
      1. cookies with data entered by the User (session identifier) for the duration of the session (user input cookies);
      2. authentication cookies used for services that require authentication for the duration of the session (authentication cookies);
      3. cookies used to ensure security, e.g., used to detect abuses in the field of authentication (user-centric security cookies);

  7. Personal Data Security
    1. The Platform Administrator constantly verifies that personal data processed by it are processed securely - ensuring, above all, that access to the data is limited to authorized persons and only to the extent necessary for the performance of their tasks. The Platform Administrator ensures that all operations on personal data are recorded and carried out only by authorized employees and associates.
    2. The Platform Administrator takes all necessary actions to ensure that its subcontractors and other cooperating entities also provide a guarantee of applying appropriate security measures in each case where they process personal data on behalf of the Platform Administrator.

  9. Privacy Policy Changes
    1. The Policy is regularly reviewed and, if necessary, updated. The current version of the Policy was adopted and is effective from 15.02.2023.
