Terms and Conditions

  • General Provisions
    1. These Terms and Conditions apply to services provided by the Administrator through the website www.transcriptmate.com.
    2. Definitions:
      1. Service - the website operated by the Administrator, through which the Administrator provides the services described below;
      2. Administrator (Service Provider) - Hinter Sp. z o.o. with its registered office in Puławy, registered in the entrepreneurs register kept by the District Court of Lublin-Wschód in Lublin with its registered office in Świdnik, VI Commercial Department, under the KRS number 0000812678;
      3. User - an individual or legal person with full legal capacity who uses the services provided by the Administrator through the Service;
      4. Terms and Conditions - these terms and conditions referred to in Article 8 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219), specifying the conditions for using the Service;
      5. Service - audio and video transcription services provided by the Administrator to the User electronically using the Service, in Polish and English;
      6. Form - a questionnaire available on the Service that enables the use of the Service;
      7. Price List - a price list posted on the website specifying the fees for a given Service;
      8. The Terms and Conditions are made available to the User free of charge on the Service. Before entering into an agreement for the provision of Services, the User has the opportunity to familiarize themselves with the Terms and Conditions.
      9. The use of the Service is equivalent to the User's acceptance of the provisions of the Terms and Conditions and the User's commitment to comply with them.
  • Payments
    1. The use of the Services by the User is subject to payment.
    2. The prices for the Services are indicated in the Price List.
    3. All prices provided in the Price List are gross prices.
    4. The Administrator reserves the right to change the prices of the Services at any time, however, for a given order, the price in force on the day of its submission remains binding.
    5. Payments for the Services are made through Stripe, which allows for payment via Blik, Apple/Google Pay, or credit card.
    6. All payment transactions are secured by the Stripe system.
    7. The Service is not responsible for any problems arising from payments made through electronic payment systems.
  • Complaints
    1. The User is entitled to submit a complaint to the Administrator within 30 days regarding the use of the Services. The complaint can be submitted electronically and sent to hello@transcriptmate.com.
    2. The complaint should include the User's name and surname, the email address appropriate for receiving a response from the Administrator regarding the complaint, and a description of the problem that has occurred.
    3. The Administrator undertakes to consider the complaint immediately, but no later than within 14 days from the date of its receipt.
  • Security and Privacy
    1. The Administrator undertakes to maintain complete confidentiality of the information provided by Users, including received audio or video recordings.
    2. The recordings provided by Users are immediately deleted after the completion of the Service.
    3. The Administrator implements appropriate technical and organizational measures to protect the transmitted data from unauthorized access by third parties.
    4. The Administrator does not disclose User data to third parties unless required by the relevant public authorities or in the event of a breach of applicable laws.
  • Personal Data Protection
    1. The personal data of Users of the Service contained in Forms, as well as automatically collected personal data, are processed in accordance with the requirements of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR).
    2. In addition, Users of the Service are entitled to rights granted to them under the respective provisions of the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2018, item 1000) and the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204). Detailed information on the protection of personal data and the privacy of users of the Service is included on the Privacy Policy page.
  • Minimum Technical Requirements for Using the Services
    1. Internet connection;
    2. Possession and provision of an email address enabling the transmission of information regarding the execution of the Service.
  • Termination of the Agreement
    1. The User who has concluded an agreement for the provision of electronic services may withdraw from it within 14 days without giving any reason.
    2. The period for withdrawing starts from the day of concluding the agreement for the provision of electronic services.
    3. The User may withdraw from the agreement for the provision of electronic services by effectively submitting a statement of withdrawal to the Administrator.
    4. In the event of withdrawal from the agreement for the provision of electronic services, it is considered as not concluded.
    5. The Service Provider is obliged to reimburse the User for all payments made by them no later than 14 days from the date of receiving the User's statement of withdrawal from the agreement.
    6. The right to withdraw from the agreement does not apply to the User in relation to agreements for the provision of services if the Administrator has fully performed the Service with the knowledge of the User who is a Consumer and who has been informed that after the performance of the Service by the Administrator, they will lose the right to withdraw from the agreement.
  • Final Provisions
    1. The Administrator reserves the right to make changes to the Terms and Conditions. Any changes will be announced on the Service. The changes will not take effect earlier than 5 days after their announcement.
    2. The Administrator reserves the right to introduce restrictions on the User's use of the Service due to maintenance or technical service.
    3. The provisions of these Terms and Conditions are not intended to exclude or limit any rights of the User who is a consumer under the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827) and the Act of 23 April 1964 - Civil Code (Journal of Laws of 2019, item 1145) which apply regardless. In the event of any inconsistency between the provisions of these Terms and Conditions and the aforementioned provisions, the latter shall take precedence.
    4. Any disputes between the Administrator and the User will be resolved amicably or in the presence of an independent and impartial mediator.
    5. In the event that a dispute cannot be settled amicably, the competent court for resolving the dispute with a User who is a consumer within the meaning of Article 22(1) of the Act of 23 April 1964 - Civil Code (Journal of Laws of 2017, item 459) is the court competent according to the provisions of Polish law.
    6. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law, in particular the provisions of the Act of 23 April 1964 - Civil Code (Journal of Laws of 2017, item 459) and other applicable provisions, shall apply.
    7. Any content or actions that in any way violate the provisions of these Terms and Conditions, as well as any problems related to the use of the Service, including the Registration Form, can be reported via email to hello@transcriptmate.com.
    8. The Terms and Conditions are valid from February 15, 2023.
